ILIST, LLC USER AGREEMENT
By using this service, you acknowledge and agree to the terms, conditions, privacy policies, and restrictions as outlined in this User Agreement (“Agreement”).
iList, LLC reserves the right to modify these terms and conditions at any time.
What is iList?
iList is a real estate marketing platform that is designed for real estate agents to engage sellers and connect them with buyer agents via marketplace.
iList provides home sellers with valuation tools, listing input automation as well as listing dashboards to manage the sale of their home.
Through a licensed subscriber a property can be marketed for sale on real estate websites and elect to receive offers through the iList platform.
The iList offer platform is designed to enhance the communication and speed of which offers can be made between parties.
No offer is considered accepted until the licensed subscriber, selling parties and buying parties have signed all required state documents.
By using iList, you are agreeing that you will abide by and follow all the terms and conditions of use as listed below.
- iList is a marketplace platform designed to be used by real estate agents.
- Any and all information entered by parties is intended for use of Listing or purchasing a property and that information shall not be used in any other way.
- Users shall not copy, redistribute or retransmit any of the information provided except in connection with the purchase or sale of an individual property.
- In relation home listings or offers and contracts, all parties understand that additional agreements will be required to proceed with listing a home or the purchase of a home.
iList requires that each user has a username and password, the combination of which is different for each user.
iList will ensure that any email address is only associated with one username and password.
You are responsible for all activities related to the Services that occur through your account and password.
It is your responsibility to keep your iList profile information accurate.
You agree to keep your password confidential, not use others' accounts, nor permit others to use your account.
iList reserves the right to terminate accounts at its discretion.
Users are required to keep information entered iList accurate and deemed reliable.
iList will maintain a record of the name, email, username and current password for each user.
iList will keep such records and all information provided by the user for not less than 180 days after the expiration of the validity of the user’s password or as required by law.
iList will not share personal information of registered users with the exception of parties involved in a user authorized real estate transaction.
iList will employ reasonable efforts to monitor for, and prevent, misappropriation, “scraping”, and other unauthorized use of stored information.
Limitation of Liability
ALL USERS, SELLERS, BUYERS, CUSTOMERS AND CONSUMERS AGREE TO INDEMNIFY AND HOLD HARMLESS ILIST, LLC and its noted Subscribers.,
AND ANY OF ITS MEMBERS, OFFICERS, OR EMPLOYEES FOR ANY AND ALL DAMAGES THAT MAY ARISE FROM THEIR USE OF THE SERVICES PROVIDED BY ILIST.
ILIST PROVIDES THE SERVICES ON AN “ASIS” AND AS AVAILABLE” BASIS. ILIST DOES NOT CONTROL OR MONITOR USER GENERATED CONTENT FOR ACCURACY.
ILIST DOES NOT PROVIDE ANY EXPRESS WARRANTIES OR REPRESENTATIONS IN ANYWAY OR MANNER. ILIST AND ITS SUPPLIERS DISCLAIM ANY AND ALL IMPLIED WARRANTIES AND REPRESENTATIONS,
INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OF DATA, AND NONINFRINGEMENT.
IF YOU ARE DISSATISFIED OR HARMED BY ILIST OR ANYTHING RELATED TO ILIST, YOU MAY DEACTIVATE YOUR ILIST ACCOUNT AND TERMINATE THIS AGREEMENT IN ACCORDANCE WITH THIS AGREMENT
AND SUCH TERMINATION SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY. ILIST IS NOT RESPONSIBLE AND MAKES NO REPRESENTATIONS OR WARRANTIES FOR THE DELIVERY OF ANY COMMUNICATION SENT
THROUGH ILIST TO ANYONE. ILIST DOES NOT HAVE ANY OBLIGATION TO VERIFY THE IDENTITY OF THE PERSONS SUBSCRIBING TO ITS SERVICES, NOR DOES IT HAVE ANY OBLIGATION TO MONITOR
THE USE OF ITS SERVICES BY OTHER USERS OF THE COMMUNITY; THEREFORE, ILIST DISCLAIMS ALL LIABILITY FOR IDENTITY THEFT OR ANY OTHER MISUSE OF YOUR INFORMATION BY OTHERS.
THE OPERATION OF THE SERVICES MAY BE INTERRUPTED DUE TO MAINTENANCE, UPDATES, OR SYSTEM OR NETWORK FAILURES.
iList is designed to be used by real estate professionals to assist home sellers in the marketing and sale of their home.
It the sole responsibility of the licensed subscriber to ensure full compliance with all local and state Realtor/ MLS regulations regarding marketing and compliance.
iList makes no representations or warranties to the use of their platform by the licensed subscriber and or agents involved in any/all transactions.
If a dispute arises between iList and a user of the service, then both parties agree to resolve their dispute using an experienced mediator.
Working with a licensed Real Estate Agent is required. Upon winning the bid, a signed contract on state or local contracts must be completed by
a licensed Agent and must be submitted within 24 hours after the winning bid along with the earnest money deposited with an escrow agent.
If not submitted in a timely manner- agent and seller reserve the right to engage and or accept other bids/ offers.
The agent representing the buyer is responsible for any questions on behalf of the buying party and explaining/ confirming the understanding
of the bidding process and expenses related.
What is the "Buyers Premium" – Using our Home Auctions option, real estate commission can be paid by the seller, the buyer or both.
The buyer’s side of the commission is called “Buyer’s Premium”. (Highest Bid + Buyer’s Premium = Sales Price)
Each property listed on our web site could offer different terms, conditions and buyers premium, so be sure to research the property and all of the details
on the property bid page.
Property will be available for viewing only on the day(s) of the open house or per the showing instructions set by the seller (unless agreed otherwise).
Buyers must be approved for financing if involved prior to bidding. It is the agent representing the buyers who is responsible to confirm this.
Sellers reserve the right to accept, negotiate or reject the highest bid – at their sole discretion.
Terms You Should Know
Bidding Auto Extend – Our system Prevents Last Second Bidding by Automatically Extending the Bidding Time.
If a bidder places a bid within 5 minutes of the end of the bidding time, the system will automatically extend the bidding
time by 10 minutes in order to allow other bidders the opportunity to respond.
